The bill, called the “Law of Foundations and Starting Points for the Freedom of Argentines”, was an attempt to implement broad reforms. One of these reforms would have given President Milei the authority to directly regulate various areas, bypassing congressional processes.

Interior Minister Guillermo Francos said that the removal of the tax regulations was due to the inability to reach an agreement in Congress on the matter. Francos said that they aim to stimulate economic growth and quickly implement regulations in this direction and that the tax provision was less of a priority and slowed down the process.

The repealed tax regulation would have allowed Argentine citizens to declare previously undeclared assets, including cryptocurrency. The first $100,000 of these assets would have been taxed at a rate of 0%, while the remaining portion would have been taxed at rates up to 15%.

In Argentina, simply owning cryptocurrency does not create a tax liability. However, according to renowned Argentine economist Marcos Zocaro, the sale of cryptocurrency and the income generated from these transactions are taxed.

Argentina’s tax authority, AFIP, considers cryptocurrency to be a financial asset and these assets are subject to different tax rates depending on where they are located. The taxable amount is calculated based on the market value determined on December 31 of each year.
