Tornado Cash Dev Denied Bail, Awaits Appeal in Jail

After his bail request was turned down, Alexey Pertsev, the Tornado Cash developer condemned to five years and four months in prison by a three-judge panel in the Netherlands on allegations of money laundering, will remain in jail while his appeal is in process.

After asking for bail, the developer’s legal team swiftly filed an appeal with the Hertogenbosch Court of Appeal following Pertsev’s conviction, hoping to get ready for the trial from home with internet access. But as DL News reports, the surprise of his defense attorney was the denial of his bail request. According to the story, Pertsev’s prison also refused the developer access to a computer to help his attorneys get ready for the trial.

“Alexey will spend the next year in jail while his legal team prepares for the appeal hearing. This is a gross miscarriage of justice. Developers do not belong in jail for the actions of third parties,” established an X account linked with JusticeDAO, which is collecting money for the legal defense of Tornado Cash’s creators.

Targeted for their work on the cryptocurrency mixing system, Pertsev is one of three Tornado Cash developers.

While prosecutors generally argue that the Tornado Cash developers either actively assisted or at least failed to stop unsavory organizations from using the platform to launder stolen funds, advocates say Tornado Cash protects privacy on the Ethereum blockchain, and targeting its developers could have chilling effects on developers who write software for blockchains.

While fellow co-founder Roman Semenov is still at large, co-founder Roman Storm’s court case is ongoing in the United States.
